These Terms and Conditions ("Terms") govern your use of the services offered by Lin Ferrer ("we," "us," "our"), including hypnotherapy sessions, consultations, and related materials (the "Services"), as well as our website www.linferrer.com (the "Website"). "Unstuck" refers to the current 1:1 hypnotherapy program offered through this practice. By booking a session or using the Website, you ("you," "client") agree to these Terms.
1. Nature of Services
1.1 We provide clinical hypnotherapy, Rapid Transformational Therapy (RTT), and related counselling services intended to support emotional wellbeing, self-understanding, and personal growth.
1.2 Our Services are not a substitute for medical, psychiatric, or psychological treatment. Hypnotherapy is a complementary approach and does not diagnose, treat, or cure any medical or mental health condition. If you are currently receiving treatment for a medical or psychiatric condition, please consult your treating physician or therapist before booking a session, and continue any prescribed treatment unless your doctor advises otherwise.
1.3 If you are experiencing a mental health crisis, suicidal ideation, or require emergency care, please contact local emergency services or a crisis helpline immediately rather than booking a session with us.
2. Eligibility
2.1 Our Services are intended for individuals aged 18 and over. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.
3. Booking and Payment
3.1 Sessions are booked through our online booking system (Calendly) or by direct arrangement.
3.2 Fees for sessions are as stated on the Website or as otherwise agreed in writing at the time of booking.
3.3 Payment is due in advance via credit card, PayPal, PayPay, or wire transfer. We reserve the right to require payment before confirming or commencing a session.
3.4 In special circumstances (for example, students or those experiencing job loss), payment in installments or a discounted rate may be made available, at the sole discretion of the service provider.
3.5 Cancellation and rescheduling: Sessions cancelled or rescheduled with at least 24 hours' notice will not be charged a cancellation fee. Sessions cancelled with less notice, or missed without notice ("no-shows"), may be charged in full.
3.6 Refunds: Fees are non-refundable once a session has taken place, but the intake/discovery call is complimentary.
4. Client Responsibilities
4.1 You agree to provide accurate and complete information about your health history, current treatment, and any conditions relevant to your sessions, to the best of your knowledge.
4.2 You are responsible for informing us of any change in your medical or psychological condition that may be relevant to your sessions.
4.3 You participate in sessions voluntarily and may stop or withdraw consent to any technique at any time.
5. Confidentiality
5.1 We treat everything discussed in sessions as confidential, subject to the limitations described in our Privacy Policy.
5.2 We may be required to disclose information without your consent where required by law, including where there is a risk of serious harm to yourself or others, or as otherwise required by a court or public authority.
5.3 Client testimonials may be used in anonymized or attributed form on our Website and marketing materials only with your explicit consent, obtained separately.
6. Recordings and Intellectual Property
6.1 Any personalized audio recordings, materials, or resources provided to you following a session are for your personal, non-commercial use only and may not be copied, distributed, or shared with third parties without our written permission. This restriction applies to the recording and materials as a whole; it does not extend to general or common phrases, affirmations, or expressions that may also appear elsewhere and are not unique to your session.
6.2 All website content, branding, and materials created by us remain our intellectual property.
7. Limitation of Liability
7.1 To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential loss arising from your use of our Services.
7.2 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Japanese law, including liability for death or personal injury caused by negligence, or liability for fraud.
7.3 Our total liability arising from the Services shall not exceed the amount you paid for the specific session giving rise to the claim, except where such limitation is not permitted by law.
8. No Guarantee of Outcome
Results from hypnotherapy and RTT vary between individuals. We do not guarantee any specific outcome, and testimonials shared on our Website reflect individual experiences, not guaranteed results for all clients.
9. Language of Sessions
Sessions may be conducted in English, Japanese, Chinese, or Korean, as agreed at the time of booking.
10. Termination
We reserve the right to decline or discontinue services to any individual at our discretion, including where continuing would not be in the client's best interest, or in cases of abusive or inappropriate conduct.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court.

本利用規約（以下「本規約」といいます）は、Lin Ferrer（以下「当方」といいます）が提供するヒプノセラピーセッション、カウンセリング、関連資料等のサービス（以下「本サービス」といいます）、および当方ウェブサイト www.linferrer.com（以下「本ウェブサイト」といいます）のご利用に適用されます。なお、「Unstuck」は、当方が現在提供している1対1のヒプノセラピー・プログラムの名称です。セッションのご予約または本ウェブサイトのご利用により、お客様（以下「お客様」）は本規約に同意したものとみなされます。
1. サービスの性質
1.1 当方は、感情面の健康、自己理解、および個人的な成長を支援することを目的として、臨床ヒプノセラピー、Rapid Transformational Therapy（RTT）、および関連するカウンセリングサービスを提供します。
1.2 本サービスは、医療、精神科的治療、または心理療法の代替となるものではありません。 ヒプノセラピーは補完的なアプローチであり、いかなる疾患または精神的な状態についても診断・治療・治癒を行うものではありません。現在、医療機関や医師の治療を受けている場合は、セッションのご予約前に主治医にご相談いただき、医師の指示がない限り、処方されている治療を継続してください。
1.3 精神的な危機、希死念慮、または緊急のケアが必要な場合は、当方へのセッション予約ではなく、直ちに最寄りの緊急サービスまたは相談窓口にご連絡ください。
2. 利用資格
2.1 本サービスは18歳以上の方を対象としています。18歳未満の場合、保護者または法定代理人の関与および同意がある場合に限り、本サービスをご利用いただけます。
3. 予約とお支払い
3.1 セッションは、オンライン予約システム（Calendly）または直接のお取り決めによりご予約いただきます。
3.2 セッション料金は、本ウェブサイトに記載のとおり、または予約時に書面で合意した内容によります。
3.3 お支払いは、クレジットカード、PayPal、PayPay、または銀行振込にて、事前にお支払いいただきます。当方は、セッションの確定または開始前にお支払いを求める権利を留保します。
3.4 特別な事情がある場合（学生の方、失業された方等）には、当方の裁量により、分割払いまたは割引料金を適用できる場合があります。
3.5 キャンセル・日程変更について： セッション開始の24時間前までにご連絡いただいたキャンセル・日程変更については、キャンセル料は発生しません。それ以降のキャンセル、または無断キャンセル（ノーショー）については、全額を請求する場合があります。
3.6 返金について： セッション実施後の返金は原則として行いませんが、初回相談（ディスカバリーコール）は無料です。
4. お客様の責任
4.1 お客様は、ご自身の健康状態、現在受けている治療、セッションに関連する状態について、把握している範囲で正確かつ完全な情報を提供することに同意するものとします。
4.2 セッションに関連する可能性のある、医学的または心理的状態の変化について、当方にお知らせいただく責任を負うものとします。
4.3 セッションへのご参加は任意であり、いつでもいかなる技法についても中止または同意の撤回をすることができます。
5. 守秘義務
5.1 当方は、プライバシーポリシーに定める制限の範囲内で、セッションでお話しいただいた内容を機密として取り扱います。
5.2 法令により開示が義務付けられる場合（お客様ご自身または第三者に重大な危害が及ぶおそれがある場合、裁判所や公的機関から開示を求められた場合等を含みます）には、お客様の同意なく情報を開示することがあります。
5.3 クライアントの声（体験談）は、別途明確な同意をいただいた場合に限り、匿名化した形または記名の形で、本ウェブサイトおよび販促資料に使用することがあります。
6. 録音物および知的財産権
6.1 セッション後に提供される個別音声データ、資料等は、お客様ご本人の非商業的な私的利用に限りご使用いただけるものとし、当方の書面による許可なく複製、配布、または第三者と共有することはできません。この制限は、録音・資料全体としての取り扱いに関するものであり、他の場面でも使用されうる一般的な言い回しやアファメーション等、お客様のセッションに固有ではない表現にまでは及びません。
6.2 本ウェブサイトのコンテンツ、ブランディング、および当方が作成した資料の知的財産権は、当方に帰属します。
7. 責任の制限
7.1 適用法令上許容される最大限の範囲において、当方は、本サービスのご利用に起因する間接的、付随的、または結果的な損害について責任を負いません。
7.2 本規約のいかなる規定も、日本法上制限または排除することができない責任（過失による死亡または人身傷害に関する責任、詐欺に関する責任等を含みます）を制限または排除するものではありません。
7.3 本サービスに起因する当方の責任の総額は、法令により制限が認められない場合を除き、当該請求の原因となった個別のセッションについてお客様が支払った金額を上限とします。
8. 効果の保証がないことについて
ヒプノセラピーおよびRTTの効果には個人差があります。当方は特定の結果を保証するものではなく、本ウェブサイトに掲載されているクライアントの声は、あくまで個々の方の体験に基づくものであり、すべてのクライアントに同様の結果を保証するものではありません。
9. セッションの言語
セッションは、予約時に合意した内容に基づき、英語、日本語、中国語、または韓国語で実施されます。
10. サービスの提供拒否・中止
当方は、セッションの継続がクライアントの利益にならないと判断される場合や、不適切な言動があった場合等、当方の裁量により、特定の個人に対するサービスの提供を拒否または中止する権利を留保します。
11. 本規約の変更
本規約は、必要に応じて改定されることがあります。変更後の規約が掲載された後も本サービスのご利用を継続された場合、改定後の規約に同意したものとみなされます。
12. 準拠法および管轄裁判所
本規約は日本法に準拠します。本規約または本サービスに起因または関連して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
